What Zuckerberg’s comments about FBI influence on suppressing Hunter Biden laptop story tell us (and don’t tell us)

In an interview with Joe Rogan that dropped August 25, Facebook CEO Mark Zuckerberg confirmed that not only did Facebook suppress the 2020 New York Post story concerning Hunter Biden’s laptop, but that it was done in response to a request from the FBI. It was the latest in a long line of official confirmations of facts previously excoriated as “conspiracy theories.”

Conservatives consider this a giant smoking gun to point to in their quest to treat social media companies as something other than purely private companies. Some libertarians are making the case Facebook and other social media companies were “coerced” into censoring information helpful to Republicans, including in 2020.

I don’t believe the officers at social media companies feel coerced, even after having been hauled in front of Congress. It’s more likely they took away from those hearings that they have to do better at something they believe is a legitimate duty: to prevent “misinformation.”

Either way, Zuckerberg’s comments provide both groups with proof that something must be done. What must be done is a thornier question.

First, it’s worthwhile to unpack Zuckerberg’s statements. There is much nuance there.

Rogan followed up Zuckerberg’s statement to ask whether the FBI requested Facebook censor the Hunter Biden story in particular. Zuckerberg replied, “No, I don’t remember if it was that specifically, but it was, it basically fit the pattern.”

Fit what pattern? The pattern of supposed Russian propaganda that damaged Donald Trump’s Democratic opponent in the 2016 election, Hillary Clinton and which again would damage Trump’s opponent in 2020. Because, you know, Putin puppet.

Zuckerberg goes on to say, “We just kind of thought, hey look, if the FBI, which I still view as a legitimate institution in this country, it’s a very professional law enforcement, they come to us and tell us we need to be on guard about something, then I want to take that seriously.”

Zuckerberg’s use of the word “still” is significant here, as the interview was recorded after the controversial FBI raid on Mar-a-Lago. It was obviously either a message to or at least an acknowledgement of the many people who no longer view the FBI as a legitimate institution, both because of the raid and its role in Russiagate fiasco over the first two years of Trump’s presidency.

It would be easy to point at some of Zuckerberg’s statements and conclude them as proof he is colluding with the government specifically to prevent Trump or anyone like him from getting elected again. I didn’t hear that. It sounded more like someone who firmly believes in the civic religion and wants to think about himself as doing the civic duty every “captain of industry” has. Or something.

That begs the question whether Zuckerberg would have suppressed a story damaging to Donald Trump under similar circumstances. It’s hard to imagine he would, but it’s possible. From his perspective, he might view it as a defending Nazis marching in Skokie sort of thing. But I wouldn’t bet my own money on it.

I walked away from the interview with the impression Zuckerberg is a typical business owner. He sounded like the vast majority of them when it comes to politics: trying his best to be as conventional and uncontroversial as possible. And like it or not, uncontroversial has meant a left-leaning centrism for at least the past one hundred years.

Blandly conventional is also the safest way to be when you’re looking to maximize revenue from sources across the political spectrum. Don’t forget Facebook also takes a lot of heat from the left for not censoring enough. That Zuckerberg’s and other Facebook officers’ personal biases are with the left make it even more likely that they would be able to view MAGA Republicans as “extremist” but Bernie Bros. as merely pushing the envelope a little.

Like all businessmen, Zuckerberg has to navigate through our grossly overregulated economy, with the threat of more regulation hanging over his head at all times. He has to consider a workforce that skews much younger and more liberal than that of the typical industry. And a majority of his customers lean left. The USA may be a federated republic, but Facebook’s customer base is not.

I am not even suggesting all of this is conscious on his part. When you spend 23 hours per day eating, drinking, and sleeping running a large company, you don’t have the bandwidth to develop complex political ideas, nor do you have the motivation to do so. When asked their political opinions, most business leaders want to sound smart and offend as few potential customers as possible.

Running a successful business means constantly overcoming distractions and stops. It’s a little like running a gauntlet. Someone complains about misinformation? Hire fact checkers. Others complain about equity issues? Make your employees go through equity training. Another group says you’re polluting the environment? Adopt ESG protocols.

Rather than part of a focused political agenda, these are all obstacles to be batted aside – or clubs to avoid being brained by – as you try to keep your head down and make it through the gauntlet to another profitable quarter.

You’re trying to make widgets and these distractions knock you off course. How do I make them go away as cheaply and quickly as possible? This is how business owners think. Take my word for it.

When is Taxpayer Day?

TAMPA, May 27, 2013 ― Today is the tenth day since Armed Forces Day. Ten straight days of “thanking the troops,” supposedly for the freedom we enjoy because of the sacrifices they’ve made.

Something needs to be said. It probably won’t be popular, but I have a sinking feeling there are more than a few people who have entertained the same heretical thought I have:

I’m sick and tired of being invited to “thank the troops,” especially for my “freedom.”

There is no disrespect intended towards the families of anyone who has died in one of the government’s wars. The loss of a child, husband, father or mother is a tragedy, regardless of the circumstances.

Moreover, it is hard not to respect the kind of courage it takes to actually go into combat, regardless of the reasons one may have enlisted.

But thanks is quite another matter. Thanks assumes that we have enjoyed some benefit as a result. We’re told that “freedom isn’t free” and the benefit we enjoy is our liberty. That begs an obvious question.

What is the cause and effect relationship between any war the U.S. government has prosecuted, at least since WWII, and whatever relative freedom Americans have left? Are we freer because our government invaded Iraq? Viet Nam? Afghanistan? How?

Asking those same questions in reverse reveals the absurdity of the whole mantra. Obviously, we would not be less free if the government didn’t invade Korea. There is no chain of events that would have followed resulting in you and I being less free to express our opinions or practice our religion. In fact, exactly the opposite is true.

In every war the U.S. has fought, Americans have become less free, especially while the war was going on. Every war president has persecuted war protesters, from John Adams to George W. Bush. Wars have brought taxes, rationing and conscription. Worst of all, American society has become permanently more militarized and socialist (but I repeat myself) with each new war.

Some argue the U.S. government has fought wars for justice, liberating people in other countries or protecting them from evildoers. That may or may not be true, but it begs two more obvious questions:

How did the American taxpayer become financially responsible for the liberty and security of every soul on the planet? When will this responsibility end?

The answer to the first question is a mystery this writer has been unable to solve. The answer to the second is obvious: When all resources are exhausted and all productive capability has been eliminated. That is the end of all military empires.

The American people have truly forgotten what a free country looks like. Worst of all are “small government” Tea Partiers who literally worship the military. Despite all of their talk about the Constitution, one has to wonder if they have ever actually read it’s authors. James Madison wrote,

“Of all the enemies to public liberty war is, perhaps, the most to be dreaded, because it comprises and develops the germ of every other. War is the parent of armies; from these proceed debts and taxes; and armies, and debts, and taxes are the known instruments for bringing the many under the domination of the few. In war, too, the discretionary power of the Executive is extended; its influence in dealing out offices, honors, and emoluments is multiplied; and all the means of seducing the minds, are added to those of subduing the force, of the people. The same malignant aspect in republicanism may be traced in the inequality of fortunes, and the opportunities of fraud, growing out of a state of war, and in the degeneracy of manners and of morals engendered by both. No nation could preserve its freedom in the midst of continual warfare.”

Free people do not worship the military establishment. They are suspicious of it. At one time the average American would not tolerate the existence of a standing army in peacetime. At the conclusion of Shay’s rebellion, John Adams and the U.S. Congress tripped over each other trying to take credit for disbanding the army.

How times have changed.

This is not a utopian vision. We live in a world of nation states, many of which could pose a threat to our liberty and security. There is a need for the means to defend ourselves if another nation besides the United States actually did show aggression. However, the present military establishment is orders of magnitude larger than any free country could possibly need or should tolerate.

The U.S. military employs approximately 1.4 million people. There is a reasonable argument to be made that all ground troops could be eliminated, given our air, naval, missile and nuclear capabilities. But let’s say for argument that 10% should be kept to train others if war broke out.

The rest are just on another government program that gives them free college, free housing, a guaranteed job and a guaranteed pension.

Meanwhile, the Forgotten Man (or woman), the one who pays for all of this, is reviled. He is never thanked. He is only ever told that he does not pay enough. Yet, it is he who actually makes us free, not by paying taxes, but by producing the wealth from which taxes are confiscated. He makes us free by allowing us to pursue our happiness, thanks to the goods and services he provides that we would otherwise have to produce ourselves. It is he who makes “society in every state a blessing.”

IRS scandal nothing new: Targeting dissenters is bipartisan

TAMPA, May 16, 2013 ― The IRS targeting conservative groups for audits and enforcement actions is the latest scandal for a federal government that is so out of control that even the lapdog media are starting to sound libertarian while covering it. But targeting dissenters is nothing new and certainly not an innovation by the Obama administration. It is old as the federal government itself.

One does not have to go back as far as the Alien and Sedition Acts or Abraham Lincoln’s imprisonment of northern journalists who opposed the Civil War. One doesn’t even have to go outside the IRS. Just nine years ago, they were doing the exact same thing under Bush, going so far as to investigate a church because of an anti-war sermon which the agency said it “considered … to have been illegal.”

Ironically, for all of their talk about “small government” and “balanced budgets,” the tea party and patriot groups most recently victimized by the IRS are for the most part rabid supporters of American militarism. So, whether you’re pro-war or anti-war, you’re a candidate for predation, so long as you oppose any aspect of the federal monster.

Conservatives are obviously making this about Obama and Obama is doing his best to deflect blame, pointing out that the activity occurred while a Bush appointee was still IRS Commissioner. Sadly, most of the American public will likely jump on one bandwagon or the other and miss what is really important here.

This is the inevitable outcome of giving any government the kind of power that the federal government has, particularly the powers granted to the IRS. You cannot enforce an income tax without inviting the government into virtually every aspect of your life. Once there, it is going to defend itself against any attack, whether related to your tax liability or not.

Let’s not forget that one of the pillars of conservative attacks on Obamacare was the thousands of new IRS agents that would be necessary to enforce its individual mandate. Tea Party and Patriot groups were largely formed around opposition to this law.

That’s what pro-war conservatives in 2012 had in common with anti-war liberals in 2004. They opposed the growth of government: the addition of new government jobs and the increase in funding. Whether for a war or a healthcare program is really immaterial. The beast just wants to grow and when it encounters opposition it defends itself like any other organism.

If the American public wants to stop the federal government from laying waste to the entire country the way it did the City of Detroit, it has to stop taking the left/right, liberal/conservative bait. There are two sides to this struggle, but they are not liberal and conservative.

They are those who benefit from the parasitical federal government and those who are victimized by it. Both groups are populated by liberals and conservatives. Let’s not forget that the majority of the military establishment is just a right wing welfare program, for individuals and large corporations alike. And it’s not like there are no liberals among that 5% of the population that pays most of the taxes.

The federal government can’t be fixed by throwing the current bums out and replacing them with new ones. It is not a job for a monkey wrench or a surgeon’s scalpel. It is a job for a motivated public armed with sledgehammers.

Libertarianism, anyone?

The real story behind those Ron Paul delegates from Maine

TAMPA, September 2, 2012 – By the time of Marco Rubio’s speech at the Republican National Convention (RNC), rhetoric overload and sore feet had overcome any desire I had to listen. I sat down at a table in the corridor of the Tampa Bay Times Forum. A few minutes later, several young people sat in the other chairs.

One of them was wearing a tee shirt that read, “Texas Remembers the Alamo, and the Maine, and the Oklahoma, and the Louisiana, and the Oregon, and the Massachusetts.”

Those are the other five states in which Ron Paul had majorities one week before the RNC. Together with the three states he actually won (Iowa, Minnesota and Nevada) Ron Paul would have carried eight states had many of those delegates not been unseated at the last minute.

The man wearing the tee shirt was Chris Howe, Ron Paul supporter and alternate delegate from Texas. Rob Hinojosa was a guest and the graphic designer of the tee shirts.

One day before, both had marched out of the RNC along with the Maine delegation and an army Ron Paul’s other delegates chanting “As Maine goes, so goes the nation!”

Howe and Hinojosa went to work on their smart phones and in short order produced Ashley Ryan, 21, the youngest national committeewoman in the history of the Republican Party.

Ryan confirmed that Ron Paul did indeed still have 20 of the 24 delegates from Maine as of the day before the RNC. They had been ready for a fight since learning of a challenge to the delegation a month earlier.

All that has been reported so far is that the delegation was contested on the grounds that the state convention did not follow “parliamentary procedure.” However, the details tell a very different story.

“The contest was filed by current national committeewoman Jan Staples and Peter Cianchette, who was the Romney state director for Maine. Those are well-known Romney supporters. They filed the contest based on the claims that our state convention lacked credentialing and lacked security. The ironic thing about that is that Jan Staples is on the executive committee for the party, so it was her job to plan the state convention. So if there was lax credentialing or if there was lax security, that would have been her fault,” explained Ryan.

Credentialing and security means that the officers of the convention ensure that all inside are who they say they are and that only duly elected delegates are present to vote.

“When they first presented their case to the contest committee, the contest committee found that there wasn’t enough evidence to invalidate the state convention or to rule against the delegates. So, instead of throwing it out like you would in a regular court of law – in a court of law if you sue someone and you don’t have enough evidence your case gets thrown out – in this situation the RNC kicked it down the line for a few more weeks and said we’ll figure it out in Tampa,” continued Ryan.

So, the convention is chaired by a Romney supporter and the national committeewoman in charge of credentialing and security is a Romney supporter. After Ron Paul supporters win a landslide victory, that same committeewoman joins Romney’s state campaign director in filing a contest based upon her own failure to ensure proper credentialing and security. The matter is put before the RNC, who are working hand in hand with Romney’s campaign.

As Ron Paul himself once wrote of the Federal Reserve System, “If that sounds fishy, then you understand it just fine.”

A call on Friday to Ms. Staples’ home phone was not returned.

Facing similar pressure, four of the five states agreed to have some of their delegates replaced with Romney supporters, but Maine held out.

“We didn’t agree to anything. We decided that we’d fight until the very end. The Committee on Contests made a recommendation to the Committee on Credentials to take 10 of our delegation off, 10 of our alternates off, so that’s 20 people total, and then the RNC hand-picked 10 delegates and 10 alternates to take their place, obviously who are all Mitt Romney supporters, all hand-picked and for the most part, party insiders” said Ryan.

So who were these unelected delegates? Are they even from Maine?

“These people are from Maine, but the people who chose these people are not from Maine. From what I’ve been told, but I haven’t been able to confirm this yet, our state party paid for them to come down, paid for their travel expenses and their hotel expenses, which a lot of people are incredibly angry about because they worked for months and in some cases years to make sure that they could afford to be here. They saved up over the four years to be able to fly down and now the state party is paying to fly down people who were never elected,” said Ryan

These details lend insight into former Republican National Committee Chairman Michael Steele’s comment to Jon Stewart that the RNC’s treatment of Ron Paul and his supporters was “the height of rudeness and stupidity.”

“Why would you alienate them,” continued Steele, “get on the floor and not let them speak? Let his name go up on the board and let them see the numbers of electoral votes that he received.”

Had all of his delegates been seated, Ron Paul would also have been entitled to a 15-minute, unedited speech.

Apologists for the RNC claim that all of this was done to ensure that the convention came off as a show of unity within the party behind its nominee for president.

One has to wonder, though. What were they really so afraid of?

Why Santorum supporters should stand with Ron Paul

TAMPA, April 10, 2012 — Rick Santorum and Ron Paul clashed frequently during the GOP debates. Santorum and his supporters suspected that Paul had made a deal with Romney, but that wasn’t it at all. Santorum and Paul had genuine disagreements about issues that matter. What is American conservatism? Is it libertarian or not? Should religious beliefs inform public policy or should the separation of church and state be absolute? In a way, it’s a shame that the race was not solely between Paul and Santorum. These are questions worthy of public discussion, unlike Mitt Romney’s tax returns or Newt Gingrich’s marital adventures.

I am a libertarian and tend to agree with Ron Paul. I tend to disagree with Rick Santorum on most things, but not on everything. However, I do grant him this. He was the most sincere of Paul’s opponents. Call me naïve, but I am convinced that he believes the things he is saying.

The Right Has It Wrong on Media Matters Campaign Against Limbaugh (Huffington Post)

Three weeks after issuing an apology for his controversial statements about Sandra Fluke, Rush Limbaugh still finds himself under attack. The latest development is Media Matters’ $100,000 ad campaign to persuade advertisers and stations to drop him. Conservative media has come out in support of Limbaugh, arguing that the campaign is “censorship” and an attack on rights guaranteed by the First Amendment.

There are so many parties wrong in this ugly dispute that it’s hard to take any side. Let’s start with a few disclaimers.

I’m a libertarian and while that doesn’t necessarily mean that I agree with conservatives on everything, I agree with Limbaugh’s substantive position on the original issue. I do not believe that the government should force insurance companies to pay for contraceptives. That’s an easy one, because I don’t believe that the government should force any party to a voluntary contract to do anything.

I didn’t particularly like the way that Limbaugh chose to express his position. I don’t believe it was necessary to hurl such vile insults to make his point. At the same time, I don’t think it calls for a campaign to ruin his livelihood. Throughout all of human history, the remedy for an insult has been an apology, even back when overdressed men in stockings used to shoot at each other at twenty paces over them.

The Free Market Resolved the Sandra Fluke Affair (Tom Mullen on the Daily Caller)

The controversy over Rush Limbaugh’s incendiary statements about Sandra Fluke and Limbaugh’s subsequent apology has reached its second week. In this age of 24-hour news cycles and government involvement in just about everything, we’ve been treated to opinions on this from presidential candidates, pundits, reporters and, of course, the president. Even in the wake of his apology, Limbaugh continues to weigh in.

We’ve also heard this incident discussed from just about every angle. Is this about religious freedom? Is it about a supposed “right to health care”? Is it about “silencing women,” as Fluke herself claimed in a recent interview?

Even Ron Paul missed an opportunity when he opined, “I think he’s [apologizing] because people were taking their advertisements off his program.”

Yes, Limbaugh apologized because he was losing sponsors. But no one on the right or the left seems to be gleaning the most important point here: the free market solved this problem.

Chapter 1

What is Freedom?

And what is this liberty, whose very name makes the heart beat faster and shakes the world?”

 – Frederic Bastiat1 (1850)

If there is one thing uniquely associated with America, it is freedom.  From the moment Cornwallis surrendered to Washington at Yorktown, America has been a symbol of liberty to the entire world.  Since the end of World War II, when the United States assumed a worldwide leadership role, it has been the leader of the “free world.”  At sporting events, standing crowds begin their ovation when the vocalist singing the national anthem gets to the words, “O’er the land of the free.”  Even in everyday conversations, scarcely a day goes by that one does not hear someone say, “Do what you like, it’s a free country.”

Although we all agree that America is the “land of the free,” there are questions about freedom that might be more difficult to answer.  What is freedom?  How is it defined?  What makes America the land of the free?  How would we know if we were to lose our freedom?  What is it that our soldiers die for and our politicians swear to defend?

We have been told a lot of things about what freedom is not.  From the end of World War II until 1991, most Americans understood that freedom was not communism.  For almost three generations, Americans lived in the “free world” during its cold war with the communist Eastern Bloc.  Without further thought or instruction, many children of the 20th century think of freedom merely as the antithesis of communism.  In some ways, this is not completely untrue, although it hardly provides a complete answer to our question.

Certainly, the mere absence of communism doesn’t necessarily guarantee freedom.  The 18th century British monarchy wasn’t communist, but the American colonists nevertheless considered it tyrannical enough to rebel against.  Likewise, the Royal House of Saud may be an ally of the U.S. government, but most Americans would not regard Saudi Arabia as a “free country.”

In addition to monarchies, there are plenty of dictatorships around the world that don’t enforce a communist system but are nevertheless oppressive.  While they also may be allies of the U.S. government, they certainly aren’t free countries, either.  So, a society is not free merely because it is not communist.

On the other hand, monarchy doesn’t seem to necessarily preclude freedom, either. Great Britain has been a relatively free country throughout much of its history, even when the monarchy was much more than a figurehead.  The American Revolution notwithstanding, Great Britain was at that time one of the freest societies in the world.  Therefore, rather than conclude that no freedom is possible under a monarchy, one might instead conclude that monarchies neither guarantee nor necessarily exclude freedom. Freedom or tyranny seems possible under almost any system of government.

Perhaps we can define freedom more easily by looking at its antithesis.  Merriam-Webster Dictionary lists slavery among antonyms for freedom.  Surely, we have found a start here.  Most people would agree that slavery is the complete absence of freedom.  Who can we imagine that is less free than the slave?  This is helpful in beginning to try to frame an answer, but freedom cannot be merely the absence of slavery.  Surely our founding fathers bled to give us a higher standard than this!

If we are told anything about what freedom is, it is that freedom is democracy.  If you ask most Americans, this is the answer you will get.  This is reinforced ad nauseum by politicians, media, and teachers in our public schools.  When Iraq held its first elections after the overthrow of Saddam Hussein, politicians and journalists universally celebrated the Iraqis’ “first taste of freedom.”

Certainly, democracy is a vast improvement over the autocratic rule of a dictator. But does democracy automatically mean freedom?  If democracy is rule by the majority, what about the minority?  What if 51 % of the people voted to oppress the other 49%?  Would that society truly be free?

Most Americans would be quite surprised to learn what our founding fathers thought about democracy.  Any objective analysis would conclude that their feelings lay somewhere between suspicion and contempt.

James Madison said, “Democracy is the most vile form of government … democracies have ever been spectacles of turbulence and contention: have ever been found incompatible with personal security or the rights of property: and have in general been as short in their lives as they have been violent in their deaths,”2

In a letter to James Monroe, he also said,

“There is no maxim, in my opinion, which is more liable to be misapplied, and which, therefore, more needs elucidation, than the current one, that the interest of the majority is the political standard of right and wrong.”3

While often extolling the virtue of majority rule, Thomas Jefferson nevertheless wrote,

“…that the majority, oppressing an individual, is guilty of a crime, abuses its strength, and by acting on the law of the strongest breaks up the foundations of society.”4

Can this be true?  The founding fathers were ambivalent about democracy?  For many people, this is tantamount to sacrilege.  More shocking still is what the Declaration of Independence and the U.S. Constitution say about democracy: nothing.  Nowhere in our founding documents will you find the word “democracy” or the assertion, implicit or explicit, that our government is a democracy.  How can this be?

Despite what we are taught virtually from birth, the United States of America has never been a democracy.  As only contrarians point out these days, it is a constitutional republic.  We choose our leaders using the democratic process of majority vote, but that is the extent to which the United States involves itself with democracy.

Like monarchy, democracy neither guarantees nor necessarily prohibits freedom.  Our founders actually feared that democracy poses a danger to freedom.  Apart from the pure heresy of the idea, it leaves us with a problem.  We are no closer to defining freedom.  If even democracy is not freedom, perhaps freedom doesn’t really exist!  If we are not to find freedom in democracy, where else can we look?

We certainly won’t learn what freedom is from our politicians.  While terrorism, healthcare, unemployment, gay marriage, and a host of other “major issues” dominate public debate, freedom is just too quaint, too academic, or too forgotten to get any airplay.  Yet, as we shall see as we explore the different subjects of this book, freedom is the fundamental issue.  In fact, despite what we perceive as a myriad of different problems facing the United States of America today, freedom is actually the only issue.  That may be hard to accept, given the decades of shoddy history, obfuscation, and plain old bad ideas we’ve been bombarded with.  Nevertheless, our greatest challenges and their solutions revolve around freedom.  If freedom is really that important, we’d better be absolutely sure we know what it is.

In order to answer the question posed by Bastiat at the beginning of this chapter, we will have to go back to the beginning.  Our founding fathers faced no such quandary about the definition of freedom. They knew exactly what it was.  They were children of the Enlightenment, and derived their ideas about freedom directly from its philosophers, especially John Locke.  While these philosophers were powerful thinkers and their ideas were (no pun intended) revolutionary at the time, the principles of liberty are relatively simple.  They are, as the namesake of this book concluded, common sense.  It was an understanding of these revolutionary ideas by average American colonists that inspired the revolution that gave birth to a nation.

The idea that opens the door to the true meaning of freedom is individual rights.  Despite the emphasis today on the “general welfare” and the “common good,” the American tradition of liberty has nothing to do with either.  Instead, the founders believed each individual was born with natural, inalienable rights.  The Declaration of Independence states,

“We hold these truths to be self evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights,” 5

This passage is quoted widely in popular culture.  Invariably, the words emphasized are “that all men are created equal.”  Certainly, these are fine words and worthy of veneration.  However, the rest of this passage is equally important.  Every human being, because of his equality with all other human beings, has rights no earthly power can take away.  These rights are “unalienable,” so that governments, even democratically elected governments, have no power to revoke them.  To the founding fathers this was self-evident.  It was true based purely upon man’s existence itself.

This idea is drawn directly from the philosophy of John Locke, who wrote,

“A state also of equality, wherein all the power and jurisdiction is reciprocal, no one having more than another; there being nothing more evident, than that creatures of the same species and rank, promiscuously born to all the same advantages of nature, and the use of the same faculties, should also be equal one amongst another without subordination or subjection,”6

While these rights are endowed by a Creator, the founders did not specify who the Creator was.  Too often, those arguing for the ideals of our republic make the fatal mistake of basing the natural rights upon belief not only in God, but specifically upon the Christian God.  While the founders were by no means opposed to Christianity, belief in it or even in God is not a prerequisite for the existence of the natural rights.  The beauty of this idea is that it transcends religion and thus welcomes members of all religions, and those with no religious beliefs at all.  Therefore, the first building block of freedom, individual, inalienable rights, can be claimed by Christians, Muslims, Jews, Buddhists, Hindus, atheists, by every person on earth.

So what are these inalienable rights, which cannot be taken away?  The Declaration goes on to say, “That among these are Life, Liberty, and the Pursuit of Happiness.”7

At first glance, this statement might be a bit deceiving, maybe even a little disappointing.  Life, Liberty, and the Pursuit of Happiness?  Is that all?  Surely we have more rights than these!  Of course, the Declaration says “among these,” so it does not limit the natural rights to these three.  But these three are important.  It is worthwhile to determine the meaning of each.

The right to life is pretty easy to understand.  Most civilized societies have laws against murder.  Each individual has a right not to be killed by another human being, except in self-defense.  So far, so good.  What about the other two?  We are in the midst of trying to define liberty, or freedom, so let us put that aside for the moment.  The third right listed is “the pursuit of happiness.”  What does that mean?  Does it mean nothing?  Or does it mean everything?  What if it makes me happy to steal cars or blow up buildings?  Surely, I don’t have a right to pursue happiness like that!

No. There is a natural limit on liberty and the pursuit of happiness. Again, we can find the answer in Locke,

“To understand political power right, and derive it from its original, we must consider, what state all men are naturally in, and that is, a state of perfect freedom to order their actions, and dispose of their possessions and persons, as they think fit, within the bounds of the law of nature, without asking leave, or depending upon the will of any other man.” 8

While people are free to do what they want, they must do so “within the bounds of the law of nature.”  What is the law of nature?  Locke goes on to tell us,

“The state of nature has a law of nature to govern it, which obliges every one: and Reason, which is that law, teaches all mankind, who will but consult it, that being all equal and independent, no one ought to harm another in his life, health, liberty, or possessions…” 9

Finally, we have some indication of what freedom is, rather than what it is not.  Liberty is not the unlimited ability to do whatever you want, nor is it confined to the arbitrary limits placed upon people by governments.  Contrary to the spurious argument that unfettered liberty would result in chaos, we see that the law of nature, Reason, very clearly and unambiguously prohibits some actions, even for people in a state of absolute liberty.  They are:

1.   Initiating the use of force or violence

2.   Infringing upon another person’s liberty

3.   Harming them in their possessions.

This last limit upon the actions of free individuals is important.  Locke spends an entire chapter of his Second Treatise talking about it.  It is related to property, which is arguably the most important right, while at the same time the least understood.  Property is important enough that we will spend the next chapter examining the subject.  To do this we will have to come to a clear definition of property, including how it is acquired, how it is exchanged, and what right the owner has to it.

More importantly, we have arrived at a definition of liberty.  It is the right of any person to do as they please, as long as they do not violate the equal rights of anyone else.  The latter half of this definition is generally referred to as the “non-aggression principle.”  Political activists associate this principle with libertarians, while intellectuals associate it with Ayn Rand’s philosophy of Objectivism.  Certainly both movements recognize and venerate it, but it is important to realize that neither is its source.  In fact, the non-aggression principle has been articulated with very little variation by all writers in the liberal tradition, including Locke, Jefferson, Paine, Bastiat, Mill, and later Rand and other 20th century writers and thinkers.

By applying this principle, the most complicated societal issues become astoundingly simple.  The ambiguous becomes unambiguous.  The answers become clear.  Virtually every problem facing America today can be solved by applying the principle of freedom.

There are a few points we should review for emphasis.  First, the rights mentioned in the Declaration of Independence and drawn out of Locke’s philosophy are inalienable.  They cannot be taken away by any power on earth, including a majority vote.  The reason the founders were suspicious of democracy was because of their fear that the majority would oppress the individual by voting away the individual’s rights, especially property rights.  This was the reason for the separation of powers and the limits on government authority.  Even a majority vote can be a threat to freedom.

The difference between a right and a privilege is a vital concept to understand.  A right is something you are born with, that you possess merely because you exist.  A privilege is something that is granted by another person, group, or a government.  Our country was founded upon the principle that all people have inalienable rights that cannot be taken away, not privileges granted by their government.  As John Adams so eloquently put it,

“I say RIGHTS, for such they have, undoubtedly, antecedent to all earthly government, — Rights, that cannot be repealed or restrained by human laws — Rights, derived from the great Legislator of the universe.”10

There is no need to be “thankful for the rights we have in America.”  All people have those rights and gratitude is neither necessary nor appropriate.  Rather, people are justified in demanding their rights, and any violation of them should be recognized as an act of aggression.

Second, in any conflict between individual liberty and the will of the majority, individual liberty prevails without compromise.  The majority has no right to violate the rights of the individual.   This is to some extent merely making the first point in reverse, but it is important enough to say in more than one way.  Society doesn’t have rights; individuals do.  Society is nothing more than a collection of individuals, so protecting each individual in society protects society.

Despite these seemingly undeniable truths, individual liberty is today under constant attack because of its perceived conflict with the common good or “the needs of society.”  While living together and agreeing not to initiate aggression against each other seems astoundingly simple, our politicians would have us believe there is something incredibly complicated about it.  They create a world in which civil society is a maze of moral dilemmas that only their astute guidance can lead us safely through.  Once liberty is properly understood and applied, all of these supposed dilemmas disappear.

Orlando Sentinel Op Ed: Vitriol Has Been a Proud Tradition

In the past, it has taken a war for the government to summon the courage to attack the very first right protected in the “Bill of Rights.” While constantly under attack, the right of free speech has withstood the invocation of all manner of horrors to convince people that it must be violated by the government to keep us safe. Now, it seems, the solitary act of a mentally ill man is enough to persuade Americans to falter.

The shooting in Arizona on January 9 was tragic. However, the argument that “irresponsible speech” had somehow helped to motivate it is completely separated from reality. In fact, the assertion that political speech is more “extreme” now than in the past is false. The spewing of raw invective at political figures is one of America’s oldest and proudest traditions.

How Do We Defeat Racism and Discrimination Once and For All?

We haven’t heard a lot lately about discrimination in the job market. Perhaps the economic crisis has pushed it into the background. “Progressives” may be too busy promoting their economic gibberish (Keynesianism) to fall back on this tried and true “divide and conquer” issue. However, as surely as night follows day, there will come a time when our friends in Congress will again need a different reason to try to tell people how to conduct their business, and nothing garners more support than railing against discrimination. When that shoe finally drops, I have a suggestion. Let’s not go back down the road of affirmative action, quotas, or any other idiotic idea that our retro-liberal Congress is likely to resurrect. There is only one remedy for discrimination in the workplace: free market capitalism.

I can speak from personal experience that this is true. I have interviewed thousands of people for jobs over the course of my life. The candidates were black, white, Hispanic, male, female, young, and old. How did I decide who to hire? I chose the same way every time. I picked the candidate that I believed would make me the most money. When I chose a black candidate or a woman, I did not do so because I wanted to promote diversity or equality. I did not do it out of altruism or for women’s rights. When I made those decisions, I had one thing and one thing only on my mind – profit.

Sometimes, I chose a white male over a black female and didn’t give it a moment’s thought. Sometimes, exactly the opposite was true. Nonetheless, in each case I chose based purely on my own self-interest (or that of my employers). I did not hire people to help them and they did not come to work for me to further some missionary cause (or even because of my sparkling personality, believe it or not). They came to work for me because the opportunity I offered them would benefit them personally more than any other available to them at the time.

The people that have worked for me in the past and who work for me now are my equals. They have skills and services to sell and I am their customer. We deal with one another in the same way that people deal with one another when buying or selling a house. I am looking to get the highest quality work that I can for the best price. They demand the highest price that they can get for their services. They choose to sell those services to me because I am willing to meet their price. If they call me “Mr.” or “Sir,” it is not out of subservience any more than the owner of an exclusive restaurant is subservient when he calls you “Sir” or “Madam” while you are paying him $150 per plate. When someone buys your product, you show gratitude for the high compliment they have paid you. They have chosen what you have to offer over all other alternatives.

Were I to make hiring decisions based upon anything other than the profit motive –based upon racial discrimination for example – the market would punish me. It would reward my competitor with a more talented employee and an advantage in the market. If I were to do this habitually, my competitors would soon have more talented employees throughout their organizations and I would be forced out of business. Anyone who has run a business knows that one cannot afford to discriminate based upon anything but profit. The market forces me to ignore race, creed, or sex for my economic survival. Only politicians remind me that I should consider demographics.

The plain fact that no politician in history has ever understood is that the market requires no altruism for everyone to benefit. Competition for employees creates higher wages and better benefits. If competition for jobs drives wages down, then the cost of production drops with wages and real wages rise despite the nominal decrease. There is no need to “balance” profit and social justice. The profit motive creates social justice. People exchanging their goods or services with one another by mutual, voluntary consent is social justice. It is only coercion that is unjust.

When people are left to themselves to deal with one another by mutual, voluntary consent, the profit motive will trump racism and discrimination every time. Show me a firm that passes on superior talent because of race or sex and I will show you a firm that is not going to be around for very long. Show me an entire industry that has put the best talent on the sidelines due to race, sex, or age, and I will be open for business in that industry the very next day. Within six months, I will be that industry’s next billionaire. The company with the most talented employees wins – every time.

This relationship between employer and employee – between buyer and seller of services – is one based upon all parties acting in their own self interest. My employees do not need my help or my altruism – they need my business, just as I need the business of my customers. They strive to perform at the absolute highest level that they can so that they can demand even more money from me for those services. I happily pay it when their improved performance increases my sales or my profits. I offer less when I can get the same performance at a lower price.

The beneficiaries of all of this are our customers. I am constantly trying to lower my costs and raise the quality of my products. I do this to gain market share and increase profits. My employees continually improve their service to our customers so that they can make more money for themselves. Higher performance from my employees is what raises the quality of my products.

Neither I nor my employees bother to stop and take note of the color of anyone’s skin or whether they are a man or a woman. We cannot afford to and, quite frankly, we just don’t have the time. This is the way the real world works. Just ask anyone who has to make a living in it. Only politicians and the people they are able to confuse see it any differently.

So, the next time your politicians bring up discrimination in the workplace, try to explain all of this to them. Tell them to put away their pamphlets and spend some time with you – working for a living. Six months spent actually earning a living rather than living off taxes collected at gunpoint would make capitalists of them all. You may say I’m a dreamer, but just imagine the freedom and prosperity that would result.
